These General Terms and Conditions are based on the version you provided.

1. Scope

These General Terms and Conditions apply to all orders placed through the BLANCCORY online store.

Our offer is primarily directed at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or independent professional activity.

Any conflicting or deviating terms and conditions of the customer shall only apply if we have expressly agreed to them.


2. Contracting Party

The purchase contract is concluded with the operator of BLANCCORY identified in our Legal Notice.

3. Products and Product Information

BLANCCORY offers functional products for everyday life and use on the go.

Our current main product is the BLANCCORY Windguard, an automatic umbrella with a ring handle.

We make every effort to present product information, images, colors, functions, and variants as accurately as possible.

Depending on the screen, display settings, and lighting conditions, colors may differ slightly from the actual product color.

The product information displayed in the store at the time of the order is decisive.

Depending on the offered variant, the Windguard includes the characteristics stated in the respective product description.

Characteristics that have not been expressly guaranteed do not automatically constitute guaranteed properties.

In particular, we do not guarantee that an umbrella:

  • will remain undamaged at every wind speed,
  • is “indestructible,”
  • is suitable for extreme weather conditions,
  • will perform identically under every conceivable condition.

Statutory rights relating to actual defects remain unaffected.


4. Conclusion of the Contract

The presentation of products in our online store generally constitutes an invitation to place an order and is not itself a legally binding offer.

You can select products, add them to your cart, and review or correct your information before completing the order.

By clicking the appropriately labeled order button, you submit a binding offer to purchase the goods contained in your shopping cart.

After receiving your order, you will receive an automatic electronic confirmation.

An automatic acknowledgment of receipt does not, by itself, necessarily mean that we have already accepted your offer.

The contract is concluded once we expressly accept the order, confirm shipment, or dispatch the goods.

For Swiss online commerce, customers must in particular be able to correct input errors before submitting an order, and the order must be confirmed electronically without undue delay.


5. Prices

The prices displayed in the store and at checkout at the time of your order apply.

Shipping costs and other mandatory charges will be displayed before completion of the order in accordance with applicable legal requirements.

Where BLANCCORY applies the German small business regulation pursuant to Section 19 UStG, VAT is not shown separately.

The information displayed at checkout and on the applicable invoice is decisive.

Switzerland

Where our offer is specifically directed at customers in Switzerland, prices and required additional costs will be displayed in accordance with the applicable requirements.

Swiss rules generally require transparent total pricing and clear information about additional costs for online stores directed at Swiss consumers.

Any import duties, customs charges, or other fees will only be borne additionally by the customer where they have been transparently disclosed before conclusion of the contract and where legally permitted.


6. Payment Terms

The currently available payment methods are displayed during checkout.

Depending on the store configuration, these may include credit card, Shopify Payments, PayPal, Klarna, Apple Pay, Google Pay, or other available payment methods.

Payment is generally due upon completion of the order unless otherwise stated for the selected payment method.

The terms of the respective payment service provider may additionally apply to payment processing.


7. Shipping and Delivery

We currently ship in particular to:

Germany
Switzerland

Delivery is made to the shipping address provided by the customer when placing the order.

Please check your address carefully before completing your order.

Estimated Delivery Times

Our current shipping methods provide the following approximate transit times:

Germany: approx. 3–6 business days
Switzerland: approx. 6–9 business days

A short processing period may apply before shipment.

These timeframes are estimated delivery periods and do not constitute a guarantee of delivery on a specific calendar date, unless a fixed delivery date has been expressly agreed.

Delivery times may in particular be affected by circumstances outside our direct control, including:

  • unusually high shipping volumes,
  • delays by shipping or logistics providers,
  • customs or import processing,
  • public holidays,
  • extreme weather conditions,
  • traffic or transportation disruptions,
  • governmental measures or comparable exceptional circumstances.

Mandatory statutory rights in the event of delivery delays remain unaffected.

For purchases in Switzerland, statutory remedies may also apply in the event of non-delivery, including the possibility of requesting performance and, where applicable, exercising further rights after an appropriate additional period.


8. Incorrect or Incomplete Shipping Address

The customer is responsible for providing a complete and correct shipping address.

If an order cannot be delivered because the customer culpably provided an incorrect or incomplete address, any actual additional shipping or processing costs may be charged to the customer where legally permitted.

The same applies if delivery fails due to circumstances attributable to the customer and this results in additional actual costs.


9. Tracking

Where available for the selected shipping method, we provide tracking information.

Tracking data is provided by the respective shipping or logistics provider.

There may be periods between individual tracking events during which no visible update appears. A temporary lack of tracking updates does not automatically mean that the shipment has been lost.

For unusually long delays, you may contact our customer support.


10. Bundle Offers, Quantity Discounts and Promotions

BLANCCORY may offer bundle deals, quantity discounts, discount codes, or limited-time promotions.

For example, different prices may apply when purchasing 1, 2, or 3 units.

The discount and final price actually applicable to your order will be displayed in the shopping cart or, at the latest, during checkout.

The total price displayed before completion of the order is decisive.

Multiple discounts or discount codes may only be combined where expressly permitted by the store.

There is generally no entitlement to the retroactive application of a discount to an order that has already been completed.

Discounts may be limited in time, changed, or discontinued, provided that already concluded contracts are not subsequently altered.


11. Obvious Pricing or Display Errors

Despite careful maintenance, technical errors may occur.

In the case of an obviously incorrect price, clearly incorrect product assignment, or comparable technical error, we are not obligated to accept an order that has not yet been accepted at the obviously incorrect value.

If a contract has already been concluded, the applicable statutory provisions shall apply.


12. Retention of Title

The goods remain our property until full payment has been received.


13. Right of Withdrawal – Germany

For consumers who have a statutory right of withdrawal, the information contained in our Withdrawal, Returns & Refund Policy applies.

For orders to Germany, consumers generally have a statutory 14-day right of withdrawal in accordance with the conditions described there.

14. Orders to Switzerland and Voluntary Returns

Swiss law generally provides no general statutory right of withdrawal for ordinary online purchases.

BLANCCORY therefore does not provide an additional general voluntary right of return for orders with a delivery address in Switzerland solely due to dislike, a change of mind, or a later preference for another color, unless otherwise expressly stated in the store or agreed in an individual case.

Mandatory statutory rights, particularly in relation to defective or incorrectly delivered goods, remain unaffected.

A voluntary goodwill decision in an individual case does not create a general entitlement to future returns.

16. Defects and Statutory Warranty Rights

Statutory rights relating to defects apply.

If you receive an item that is demonstrably:

  • damaged,
  • incorrect,
  • incomplete,
  • or defective,

Where possible, please provide:

  • order number,
  • a short description of the issue,
  • suitable photos or videos,
  • where applicable, photos of the packaging in the case of shipping damage.

This information helps us review the case more quickly.

A request for prompt voluntary notification does not limit statutory claims.

For Swiss consumers, statutory warranty periods and mandatory consumer protection requirements remain applicable.

We do not provide any voluntary additional guarantee beyond the applicable statutory rights unless such a guarantee is expressly offered for a specific product.


17. Use of the BLANCCORY Windguard

The BLANCCORY Windguard is intended to be used as an umbrella.

When using the automatic opening mechanism, please maintain sufficient distance from:

  • people,
  • faces and eyes,
  • animals,
  • vehicles,
  • fragile objects.

The mechanism should not be forcibly blocked, bent, or used contrary to its intended function.

The Windguard is designed for everyday weather conditions.

During exceptionally strong wind or storm conditions, the umbrella should not be used where safe use cannot be ensured.

Damage caused exclusively by demonstrably improper, unintended, or forceful use does not automatically constitute a product defect.

Mandatory statutory rights relating to defects, product liability, and consumer protection remain unaffected.


18. Liability

We accept unlimited liability:

  • in cases of intent,
  • in cases of gross negligence,
  • for injury to life, body, or health,
  • under applicable product liability law,
  • and in all other cases where liability is mandatory by law.

In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for the contract, where legally permitted.

Essential contractual obligations are obligations whose fulfillment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely.

In all other respects, liability is excluded to the extent legally permitted.

Liability does not arise solely because a non-binding estimated delivery timeframe is slightly exceeded due to circumstances outside our area of responsibility.

Mandatory consumer, warranty, and product liability rights are not restricted by this provision.


19. Events Outside Our Control

In the event of exceptional and unforeseeable circumstances outside our reasonable control — such as natural events, significant transportation disruptions, governmental measures, or comparable events — processing and delivery times may be extended.

In such cases, we will make reasonable efforts to resolve the situation as quickly as possible.

The customer's statutory rights, particularly in the event of significant delivery delays or permanent impossibility of performance, remain unaffected.

21. Applicable Law

The law of the Federal Republic of Germany shall generally apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

However, if you are a consumer, this choice of law does not deprive you of mandatory consumer protection provisions that cannot be excluded by agreement under the applicable legal rules.

This also applies in particular to cross-border consumer orders.

For Swiss customers, consumer jurisdiction rules may also apply under certain circumstances where an offer is specifically directed at Switzerland.


22. Consumer Dispute Resolution

Where there is no legal obligation to do so, we are not willing to participate in dispute resolution proceedings before a consumer arbitration board.

We do not include a reference to the former European ODR platform, as that platform was discontinued in 2025.


23. Changes for Future Orders

We may amend these Terms and Conditions for future orders if our offering, technical processes, or legal requirements change.

The Terms and Conditions in effect at the time the relevant contract is concluded generally apply to that order.

A later amendment to these Terms and Conditions does not alter an already concluded contract without an appropriate legal basis.


24. Final Provisions

If any individual provision of these Terms and Conditions is or becomes wholly or partially invalid or unenforceable, the remaining provisions shall generally remain unaffected to the extent legally permitted.

The applicable statutory provisions shall apply in place of any invalid provision.
